Soil Baseline Report

Our teams undertake subsoil (soil and groundwater) investigation and characterisation to draft the baseline report required to apply for a renewal of the Environmental Authorisation. 

The Soil Baseline Report is a subsoil (soil and groundwater) investigation/characterisation that is developed by applying methodologies set out in the above section. The implementation of the European Industrial Emissions Directive (IED) on the integrated pollution prevention and control involves the request of new requirements from new and existing facilities included in Annex I.1 of Law 20/2009 (IPPC facilities).

On 12th June 2013, State Law 5/2013, governing modification of Law 16/2002, governing integrated prevention and control of contamination and Law 22/2011, governing waste and contaminated soil was published. This standard, which partially transfers the IED, is basic and, as such, affects all Autonomous Communities.

On 19th October 2013, the transposition of the IED to legislation of the Spanish State was completed, through the publication of RD 815/2013, which approves the regulation of industrial emissions and the development of Law 16/2002, governing integrated prevention and control of contamination. In the Autonomous Communities, given that these are basic regulations, they will lead to compliance with the Law governing environmental prevention and control of activities (IPPC facilities).

IPPC activities upon applying for a renewal of the Integrated Environmental Authorisation, should include the new requirements, that with regard to soil and groundwater entail:

• obligation to establish in which conditions the facility will be closed. In this respect, it is important to point out that any IPPC facilities that manufacture, use or handle pertinent hazardous substances are bound to quantitatively assess the state of the subsoil and groundwater. This assessment or baseline report will be used as an initial position for the closure of the facilities.
   
• Additionally, any facilities that manufacture, use or handle pertinent hazardous substances are bound to set control prescriptions in relation to soil and groundwater. The baseline report is a subsoil (soil and groundwater) investigation/characterisation that is developed by applying methodologies set out in the above section.”
